Welcome to Z-FIT, your personal fitness companion. These Terms and Conditions ("Terms") govern your use of the Z-FIT mobile application and associated services. Please read them carefully before using the application. By downloading, installing, or using Z-FIT, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Z-FIT mobile application ("Application"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, do not use the application. These terms constitute a binding legal agreement between you and Z-FIT.
2. Health and Fitness Disclaimer
Z-FIT is a fitness tracking and workout planning tool. It is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult with a physician before starting any new exercise or nutrition program. You acknowledge that physical exercise involves risks of injury, including but not limited to cardiovascular events, musculoskeletal injuries, and other health complications. You voluntarily assume all such risks. Z-FIT is not responsible for any injuries, health problems, or adverse effects you may experience as a result of using the application. Users with pre-existing medical conditions should obtain physician approval before using the app.
3. Privacy and Data Security
Your privacy is important to us. We collect and process your personal data (including height, weight, age, fitness goals, workout history, and activity data) in accordance with our Privacy Policy. We use industry-standard security measures, including encryption and secure servers, to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. Your data may be processed and stored on secure cloud servers.
4. User Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, including your password and login information. You agree to provide accurate, complete, and current information during registration and to update it as necessary. You are responsible for all activities that occur under your account. Z-FIT reserves the right to suspend or terminate accounts that: (a) violate these terms, (b) engage in harmful or illegal activities, (c) are inactive for extended periods, or (d) pose a security risk.
5. Intellectual Property Rights
All content, features, functionality, design, graphics, text, and intellectual property contained within the Z-FIT Application are owned by Z-FIT or its content suppliers and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, transmit, or display any content without our express written permission. Unauthorized use of any content is a violation of these terms and applicable laws.
6. User-Generated Content
Any content you create, upload, or submit through the Application (including workout logs, photos, comments, and personal data) remains your property. By submitting content, you grant Z-FIT a non-exclusive, worldwide, royalty-free license to use, display, and analyze such content for improving the application and providing services. You represent that you own or have the necessary rights to share any content you upload.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Z-FIT and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from: (a) your use or inability to use the application, (b) any content or information obtained through the application, (c) unauthorized access to your data, or (d) any other matter relating to the application. This includes loss of data, revenue, or business opportunities.
8. Changes to Terms and Service
Z-FIT reserves the right to modify these Terms and Conditions at any time. We will notify users of significant changes via email or through the application. Your continued use of the application after such modifications constitute your acceptance of the updated terms. If you do not agree with the changes, you should discontinue use of the application.
9. Third-Party Links and Services
The Application may contain links to third-party websites and services. Z-FIT is not responsible for the content, accuracy, or practices of these external sites. Your use of third-party services is governed by their own terms and conditions. We encourage you to review their policies before providing any personal information.
10. Prohibited Activities
You agree not to use the Application to: (a) engage in unlawful activities, (b) harass, threaten, or harm others, (c) transmit malware or harmful code, (d) attempt to gain unauthorized access to the system, (e) reverse-engineer or decompile the application, (f) use the app for commercial purposes without permission, or (g) violate any applicable laws or regulations.
11. Warranty Disclaimer
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Z-FIT DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Z-FIT DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Termination
Z-FIT may terminate or suspend your account and access to the Application at any time, with or without cause, and without prior notice. Upon termination, your right to use the application ceases immediately. Surviving provisions of these terms (including Limitation of Liability and Governing Law) shall continue in effect after termination.
13. Indemnification
You agree to indemnify, defend, and hold harmless Z-FIT and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your violation of these terms, your misuse of the application, or your violation of any applicable laws.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Z-FIT operates, without regard to its conflict of laws provisions. Any disputes shall be resolved exclusively in the courts of that jurisdiction. You agree to submit to the personal jurisdiction of such courts.
15. Severability
If any provision of these terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.
